1. Acceptance of Terms

By using OverAir (the "Service"), operated by Hens Desenvolvimento ("we", "us", "our"), you agree to these Terms of Use. If you do not agree with any part of these terms, do not use the Service.

2. Description of the Service

OverAir is a digital memory service that captures messages sent via WhatsApp (audio, text, and image), processes them using artificial intelligence, and organizes the extracted information in a mobile application.

The Service uses Meta's WhatsApp Business API. By using OverAir, you are also subject to the WhatsApp Terms of Service and the WhatsApp Privacy Policy.

3. Registration and Account

To use the Service, you must provide your phone number via WhatsApp. You are responsible for keeping your account secure and for all activity that occurs under it.

4. Acceptable Use

You agree to use the Service only for personal and lawful purposes. The following are prohibited:

  • Using the Service for any illegal or unauthorized purpose
  • Sending content that infringes third-party rights
  • Attempting to access other users' data
  • Using the Service for spam or bulk messaging
  • Interfering with the operation of the Service or its servers

5. Data Processing

OverAir processes the messages you send (audio, text, and image) to extract structured information. Important:

  • Photos and images are processed for data extraction (such as values from receipts), but are not stored. Only the extracted data is saved.
  • Audio is transcribed by the artificial intelligence. The resulting text is stored; the original audio file is not kept permanently.
  • Text is analyzed and categorized automatically.

6. Plans and Payment

The Service offers free and paid plans. Paid plans are billed monthly via credit card or boleto, processed through the Stripe platform. The values and benefits of each plan may be changed with 30 days' prior notice.

There are no refunds for partial usage periods. You may cancel your plan at any time, and paid access will be maintained until the end of the period already paid.

7. Intellectual Property

The Service, including its interface, code, design, and brand, is the property of Hens Desenvolvimento. You retain ownership of the data and content you send to the Service.

8. Limitation of Liability

The Service is provided "as is", without warranties of any kind. We are not liable for:

  • Data loss caused by technical failures
  • Errors in transcription or categorization performed by the artificial intelligence
  • Temporary unavailability of the Service
  • Indirect damages resulting from use of the Service

9. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without prior notice. You may terminate your account at any time by contacting us via WhatsApp.

10. Changes to the Terms

These Terms of Use may be changed at any time, without prior notice. Changes take effect immediately upon publication on this page. Continued use of the Service after any change constitutes acceptance of the new terms.

We recommend that you review this page periodically to stay informed of any changes.

11. Governing Law

These Terms are governed by the laws of the Federative Republic of Brazil, in particular the Consumer Protection Code (Law No. 8,078/90), the Brazilian Internet Civil Framework (Law No. 12,965/14), and the General Data Protection Law (Law No. 13,709/18 — LGPD).
